Last Updated: April 30, 2024These Terms and Conditions ("Terms") form a binding agreement between JB Media (“we”, “us”, “our”) and you, the Client (“you”, “your”), for the use of our photography and videography services.By booking any services with JB Media, you acknowledge that you have read, understood, and agree to be bound by the following terms.
1. General
These Terms apply to all services provided by JB Media, including those performed by our contractors or subcontractors. They remain in effect until either party agrees in writing to terminate services.
2. Payment
All payments are in South African Rand (ZAR) via Credit Card, Wise, or EFT.A 50% non-refundable deposit is required to secure a booking.The remaining 50% is due upon completion of the project or the scheduled delivery date—whichever comes first.Final deliverables will only be released once full payment is received.Invoices are payable within 30 days. Overdue invoices incur a 10% late fee after 5 days.Usage rights are only granted once full payment has been received.
3. Quotes & Proposals
All quotes are based on the project brief and estimated time investment.Quotes are valid for 30 business days.Project timelines are approximate and may vary depending on workload or client response times.
4. Bookings
A project is only confirmed once the 50% deposit is paid.Once confirmed, we’ll email you to finalise timelines and next steps.
5. Cancellations & Termination
You may cancel services at any time with written notice. The deposit is non-refundable.If cancelled partway through, fees for completed work to date will apply.We may terminate the agreement if you breach terms, fail to pay, or cease business operations.
6. Project Delays
Delays due to missing content or approvals from your side will result in extended delivery timelines.Neither party is liable for delays caused by events beyond our control (e.g., load shedding, illness, acts of God).
7. Scope & Additional Work
Projects include up to three (3) rounds of minor refinements (e.g., colour tweaks, image swaps, text edits).Additional changes or requests outside the agreed scope will be billed at R550/hour.Scope changes must be requested in writing and approved before proceeding.
8. Rush Work
Expedited work requested outside of normal hours or schedule will incur a 50% rush fee.While we aim to accommodate urgent requests, quality is our priority and may not be compromised.
9. Review & Approval
You have 10 business days to request changes once deliverables are sent.If no feedback is received within 10 days, the deliverables will be deemed approved.
10. Technology & Website Disclaimer
For domain, hosting, email or SSL issues, please contact your provider directly.JB Media is not responsible for hacked websites, email spam, downtime, or hosting/server-related errors.
11. Intellectual Property & Usage
JB Media retains copyright of all designs and materials until full payment is made.We reserve the right to showcase our work on our website and social channels, unless agreed otherwise in writing.You may not alter our work without permission.
12. Design Credit
A small credit link to JB Media may be included on photos and videos we create.We reserve the right to include completed projects in our portfolio.
13. Limitation of Liability
Our services are provided “as is” without warranties.JB Media shall not be liable for indirect or consequential losses, including lost revenue or business interruption.
14. Confidentiality
Both parties agree to keep confidential information shared during the project strictly confidential.
15. Dispute Resolution
If a dispute arises, we’ll aim to resolve it through open communication or, if necessary, formal mediation or arbitration in South Africa. The prevailing party may recover legal costs.
16. Governing Law
These Terms are governed by the laws of South Africa.
17. Agreement
By booking our services, you agree to these Terms and confirm you are authorised to enter into this agreement.
